Terms & Conditions

These Terms & Conditions govern your use of AwayGameTailgate.com and your purchase of, registration for, or participation in events organized by Away Game Tailgate.

By purchasing a tailgate pass, registering for an event, submitting an order, or attending an Away Game Tailgate event, you agree to these Terms & Conditions.

Please review them before purchasing or attending.

1. About Away Game Tailgate Events

Away Game Tailgate organizes pre-game tailgate experiences at or near MetLife Stadium in East Rutherford, New Jersey, as well as other events that may be offered from time to time.

Our public tailgates generally include food, non-alcoholic beverages, music, televisions, tailgate games, and other activities as described on the applicable event page.

Specific offerings, menus, activities, locations, schedules, and amenities may vary by event.

Private events may be subject to a separate proposal, contract, or written agreement. If the terms of a separate written agreement conflict with these Terms & Conditions, the separate agreement will control for that private event.

2. Tailgate Passes Are Separate From Game Tickets and Parking

Unless expressly stated otherwise on an event page, an Away Game Tailgate pass provides admission only to the Away Game Tailgate event.

A tailgate pass does not include:

• Admission to the football game, concert, or other stadium event
• A MetLife Stadium event ticket
• A parking permit
• Transportation to or from the event
• Any product or service not specifically listed as included with the tailgate pass

Guests are responsible for obtaining their own game or event tickets, parking passes, transportation, and any other required admission credentials.

Problems involving a guest’s game ticket, parking pass, transportation, traffic, rideshare, public transportation, or stadium admission do not entitle the guest to a refund of an Away Game Tailgate pass if the tailgate event takes place as scheduled.

3. Payment and Pricing

All payments must be made in full at the time of purchase unless otherwise stated.

Prices are subject to change without notice. A price change after a completed purchase will not change the amount paid for an existing confirmed order.

Tickets may be sold directly by Away Game Tailgate or through an authorized third-party ticketing platform.

Additional service, processing, delivery, or transaction fees charged by a third-party ticketing provider may be subject to that provider’s separate terms and policies.

4. Third-Party Ticketing Services

Away Game Tailgate may use third-party ticketing companies, including platforms such as TickPick, to sell or distribute tailgate passes.

Purchases made through a third-party platform are also subject to the terms, conditions, payment policies, and privacy policies of that provider.

Away Game Tailgate is not responsible for third-party website outages, payment processing errors, account issues, delivery problems, or fees charged directly by a third-party provider.

Guests should purchase tailgate passes only through Away Game Tailgate or an authorized ticketing source. We cannot guarantee admission for counterfeit, duplicated, improperly transferred, or unauthorized tickets.

5. All Sales Are Final

Unless otherwise expressly stated, Away Game Tailgate ticket purchases are final and non-refundable.

Refunds will not be provided because a guest:

• Is unable to attend
• Arrives late or leaves early
• Changes travel plans
• Experiences traffic or transportation delays
• Cannot obtain parking
• Cannot obtain or use a game or stadium ticket
• Is denied admission to the stadium
• Does not agree with a menu or activity change
• Is removed from the tailgate for violating these Terms & Conditions
• Experiences rain, cold, heat, wind, or other ordinary weather conditions when the tailgate proceeds

Purchasers are responsible for confirming event dates, times, and other relevant information before completing their purchase.

6. Rain or Shine

Away Game Tailgate events are generally held rain or shine.

Weather conditions alone will not automatically result in cancellation or a refund.

Away Game Tailgate may modify the event setup, menu, tent configuration, entertainment, games, television setup, or other features when reasonably necessary because of weather, safety conditions, venue requirements, or operational considerations.

If severe weather or another safety concern makes it unsafe or impossible to proceed, Away Game Tailgate may delay, modify, relocate, reschedule, or cancel the event.

7. Event Cancellations

If Away Game Tailgate cancels a tailgate event and does not reschedule it, the original purchaser will be eligible for a refund of the tailgate admission amount paid to Away Game Tailgate.

Third-party ticketing, processing, or service fees may be governed by the policies of the company that charged those fees.

A cancellation or postponement of the underlying football game, concert, or stadium event does not necessarily mean the Away Game Tailgate event has been canceled. Customers should wait for official communication from Away Game Tailgate regarding the status of the tailgate.

8. Schedule Changes and Rescheduled Games

Football games and other stadium events may have their dates or kickoff times changed after schedules are initially announced.

If the underlying event is rescheduled or its start time changes, Away Game Tailgate may adjust the date and/or time of the corresponding tailgate.

Unless the tailgate itself is canceled without being rescheduled, schedule changes do not automatically qualify for a refund.

Guests are responsible for checking the applicable event page and Away Game Tailgate communications as the event date approaches.

9. Event Location

Event locations and directions will be provided on AwayGameTailgate.com, the applicable event page, confirmation communications, or other official Away Game Tailgate channels.

Event locations may be adjusted when necessary because of parking arrangements, venue requirements, safety considerations, construction, weather, traffic management, or other circumstances outside our control.

Guests should check the event page and communications before arriving.

Away Game Tailgate is not responsible for guests going to an incorrect location after updated directions have been provided.

10. Venue and Property Rules

Guests must comply with all laws and all rules, regulations, instructions, and safety requirements applicable to the property where an Away Game Tailgate event is held.

Rules established by MetLife Stadium, the MetLife Sports Complex, parking operators, property owners, law enforcement, event organizers, or other authorities may change without notice.

Away Game Tailgate may modify its event operations when necessary to comply with these requirements.

Activities, equipment, games, tents, food service, photography, filming, music, or other aspects of an event may be altered or discontinued if required by the venue, property owner, law enforcement, or applicable regulations.

11. BYOB and Alcohol Policy

MetLife-area tailgate events operated by Away Game Tailgate are BYOB for alcoholic beverages unless expressly stated otherwise.

Away Game Tailgate does not furnish alcoholic beverages at events identified as BYOB.

Guests choosing to bring or consume alcoholic beverages are solely responsible for complying with applicable law and venue or property rules.

Alcohol may only be possessed and consumed by individuals legally permitted to do so. No person under 21 years of age may consume alcoholic beverages.

Guests may not provide alcohol to a minor or to anyone who should not legally possess or consume alcohol.

Guests are expected to drink responsibly. Away Game Tailgate reserves the right to refuse entry to or remove any individual who appears dangerously intoxicated, behaves in an unsafe manner, creates a disturbance, or presents a risk to themselves or others.

Anyone consuming alcohol is responsible for arranging safe transportation and must not drive while impaired.

12. Minors and Family Attendance

Away Game Tailgate events are family-friendly unless an individual event is expressly designated otherwise.

Children and minors must remain under the supervision and responsibility of a parent, legal guardian, or responsible accompanying adult.

Parents and guardians are responsible for monitoring children’s participation in games, activities, food service areas, and other portions of the tailgate.

Away Game Tailgate does not provide childcare or supervision of individual children.

13. Food, Dietary Requests, and Allergies

Food selections are described on our website and event pages when available. Menus may change due to availability, supply issues, event requirements, or other operational considerations.

Vegetarian options may be available as described for an individual event.

Guests with food allergies, sensitivities, dietary restrictions, or other food-related concerns should notify Away Game Tailgate before the event and speak with staff before consuming food.

Although we will make reasonable efforts to provide accurate information, Away Game Tailgate cannot guarantee that food or preparation areas are completely free from allergens or cross-contact.

Guests with serious or life-threatening allergies are responsible for taking appropriate precautions.

14. Event Conduct

Away Game Tailgate is intended to provide a welcoming, fun, and family-friendly experience for football fans and other guests.

Attendees must behave respectfully toward other guests, employees, contractors, neighboring tailgates, property owners, security personnel, and law enforcement.

The following behavior may result in immediate removal without refund:

• Fighting or physical aggression
• Threats or harassment
• Dangerous or reckless behavior
• Illegal activity
• Excessive intoxication
• Destruction of property
• Throwing objects
• Interference with event staff
• Discriminatory, threatening, or abusive conduct
• Unauthorized selling, solicitation, or distribution of products or materials
• Failure to comply with applicable safety or venue rules
• Any conduct Away Game Tailgate reasonably determines presents a safety concern or substantially interferes with other guests’ enjoyment of the event

Away Game Tailgate reserves the right to contact security or law enforcement when appropriate.

15. Personal Property

Guests are responsible for their own belongings.

Away Game Tailgate is not responsible for lost, stolen, misplaced, damaged, or abandoned personal property, including but not limited to phones, bags, clothing, coolers, beverages, chairs, tickets, or other belongings, except where liability cannot legally be excluded.

Guests may bring their own chairs when permitted by the event location.

Seating may be included with certain VIP packages as specifically described at the time of purchase.

16. Participation in Tailgate Activities

Participation in cornhole, games, activities, or other entertainment is voluntary.

Guests should participate responsibly and according to staff instructions and applicable property rules.

Activities may be modified, limited, relocated, or discontinued because of weather, available space, safety concerns, venue requirements, or other circumstances.

17. Assumption of Risk

Attending an outdoor tailgate event involves ordinary risks associated with crowds, parking areas, changing weather, food and beverage consumption, walking on uneven surfaces, recreational games, tents and equipment, traffic, and interaction with other attendees.

By voluntarily attending an Away Game Tailgate event, you acknowledge and accept the ordinary and inherent risks associated with participating in such an event.

Nothing in these Terms & Conditions waives any legal right or liability that cannot lawfully be waived under applicable law.

18. Photography, Video, and Media Rights

Away Game Tailgate events may be photographed, filmed, livestreamed, or otherwise recorded by Away Game Tailgate or its authorized representatives where permitted by applicable law and the rules of the event property or venue.

By attending an event, you acknowledge that you may appear in photographs, video, audio recordings, or other event media.

To the extent permitted by law, you grant Away Game Tailgate permission to use your image, likeness, appearance, and voice captured during the event for legitimate business and promotional purposes, including:

• Social media
• Digital advertising
• Email marketing
• Promotional videos
• Event recaps
• Printed marketing
• Future Away Game Tailgate promotions

Such use may occur without additional approval or compensation.

A parent or legal guardian attending with a minor acknowledges that general event photography may include the minor and, to the extent legally permitted, authorizes the use of such event media.

Guests with concerns about being intentionally featured in close-up promotional photography or video should notify Away Game Tailgate staff. We will make reasonable efforts to accommodate such requests. However, we cannot guarantee that a guest will not appear incidentally in general crowd, background, or event photography.

19. Privacy

Information collected through AwayGameTailgate.com, event inquiries, purchases, registrations, and other communications is handled according to our Privacy Policy.

Our Privacy Policy is incorporated into these Terms & Conditions by reference.

Third-party ticketing, payment, transportation, social media, or other service providers maintain their own privacy policies and practices.

20. Brand and Team Affiliation Disclaimer

Away Game Tailgate is an independent event organizer.

Unless expressly stated otherwise, Away Game Tailgate is not affiliated with, sponsored by, endorsed by, or officially associated with MetLife Stadium, the New York Giants, the New York Jets, the National Football League, visiting NFL teams, collegiate teams, performers, leagues, event promoters, or other brands referenced on the website.

Team names, event names, trademarks, logos, and other intellectual property belong to their respective owners and are used for identification or descriptive purposes where appropriate.

Away Game Tailgate provides independent fan-focused pre-game experiences.

21. Third-Party Services and Links

AwayGameTailgate.com may contain links to third-party websites or services, including ticketing providers, parking providers, transportation companies, stadium websites, hotels, sponsors, partners, social media platforms, and other services.

Away Game Tailgate does not control these third-party services and is not responsible for their availability, pricing, policies, performance, accuracy, security, or conduct.

A link or reference to a third-party provider does not create responsibility for that provider’s products or services.

22. Website Information

Away Game Tailgate makes reasonable efforts to keep event information accurate and current.

However, schedules, game times, locations, menus, parking arrangements, transportation details, ticket availability, prices, and other information may change.

Information concerning MetLife Stadium, football schedules, parking policies, team schedules, transportation, or other third-party matters should also be confirmed with the applicable official source.

23. Force Majeure and Circumstances Beyond Our Control

Away Game Tailgate shall not be responsible for delays, changes, interruptions, or failure to provide particular event features caused by circumstances reasonably beyond our control.

These circumstances may include severe weather, natural disasters, government actions, venue restrictions, public safety conditions, emergencies, acts of terrorism, civil disturbances, transportation disruptions, utility failures, labor disputes, property restrictions, schedule changes, or similar events.

When possible, Away Game Tailgate will make reasonable efforts to modify, relocate, reschedule, or otherwise provide the event.

If Away Game Tailgate ultimately cancels the tailgate and does not reschedule it, the cancellation provisions in these Terms will apply.

24. Limitation of Liability

To the fullest extent permitted by applicable law, Away Game Tailgate and its owners, employees, contractors, representatives, and affiliates will not be liable for indirect, incidental, special, or consequential losses arising from attendance at an event or use of the website.

Away Game Tailgate is not responsible for acts or omissions of unrelated third parties, including stadium operators, sports teams, ticketing providers, transportation companies, parking operators, security personnel, vendors, other attendees, or government authorities.

Nothing in these Terms & Conditions limits liability that cannot legally be limited or excluded.

25. Responsibility for Your Conduct

You are responsible for losses, property damage, injuries, claims, costs, or expenses caused by your unlawful conduct, intentional misconduct, violation of these Terms & Conditions, or damage you cause to people or property.

To the extent permitted by law, you agree to indemnify and hold harmless Away Game Tailgate and its owners, employees, contractors, and representatives from third-party claims arising from such conduct.

26. Acceptance on Behalf of a Group

If one person purchases multiple tailgate passes for a group, that purchaser is responsible for making these Terms & Conditions available to the other attendees in the group.

Each person attending an Away Game Tailgate event is subject to the applicable event rules regardless of who purchased the ticket.

27. Governing Law and Disputes

These Terms & Conditions are governed by the laws of the State of New Jersey, without regard to conflict-of-law principles.

The parties agree to first attempt in good faith to resolve any dispute directly.

Subject to applicable law and the enforceability of any arbitration requirement, unresolved disputes arising from these Terms & Conditions or participation in an Away Game Tailgate event may be submitted to binding arbitration in New Jersey.

Nothing in this provision prevents either party from pursuing a remedy that applicable law specifically permits to be brought in court.

28. Changes to These Terms

Away Game Tailgate may update these Terms & Conditions from time to time.

Changes will be posted on AwayGameTailgate.com with an updated revision date.

For ticket purchases, the version of the Terms & Conditions in effect at the time of purchase will generally govern that transaction, except where a later change is required by law or relates to event safety or venue requirements.

29. Severability

If any provision of these Terms & Conditions is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.

30. No Waiver

Failure by Away Game Tailgate to enforce a provision of these Terms & Conditions on one occasion does not waive the right to enforce that provision in the future.

31. Entire Agreement

These Terms & Conditions, together with the applicable event description, Privacy Policy, order confirmation, and any other policy expressly incorporated by reference, constitute the agreement between you and Away Game Tailgate regarding the applicable tailgate event.

Private-event customers may also have a separate written contract or proposal that supplements or replaces portions of these Terms.
